Relevant Regulations and Legislation for International Student Recruitment by Destination:
To maintain compliance and best practices across all our global destinations, we also align agent activities with the following regulations and legislative frameworks:
Australia
In Australia, all Educational Advisors must abide by:
- Education Services for Overseas Students Act 2000 (ESOS Act)
- The National Code of Practice for Providers of Education and Training to Overseas Students 2018 ‘The National Code’
- Migration Act 1958
In addition, Educational Advisor should also familiarise themselves with and abide by the Australian International Education and Training Agent Code of Ethics which outlines principles and expectations of fair and ethical conduct of Educational Advisors.
Canada
National Level: In Canada, all Educational Advisors must comply in all respects with all provisions and specifically Section 91 (formerly, Bill C-35) of the Immigration and Refugee Protection Act 2001 “IRPA” plus any regulations made under IRPA including the Immigration and Refugee Protection Regulations, including without limitation, provisions relating to representation or advice on an immigration application, proceeding or matter by any party. Additionally Educational Advisors should also familiarise themselves with and abide by the CBIE Code of Ethical Practice.
Provincial Level: When operating in or sending students to providers located in British Columbia and Manitoba an additional provincial layer of regulation must be adhered to.
BC: All Educational Advisors are required to read, understand and conduct themselves at all times, in a manner that is not contrary to the provisions, values and guidelines set out in the British Columbia Ministry of Post-Secondary Education and Future Skills Code of Practice for Educational Quality Assurance (EQA).
MB: All Educational Advisors are required to read, understand the requirements outlined in both the Manitoba International Education Act (Bill 44) and ‘The Guide to the Code of Practice and Conduct for Manitoba Designated Education Providers, their Staff Recruiters, and Contracted Agents’.
France
The Code de l’éducation (education code) unites all legislative and regulatory provisions relating to the French educational system in a single reference document. The French civil law codes do not have specific national regulations regarding the recruitment of international students nor management of Educational Advisors. Formal agreements are used to outline the responsibilities, expectations, and ethical standards that Navitas should hold EAs accountable to.
In the absence of French regulations the UK Agent Quality Framework will be adopted as the minimum standard.
Étudiant | Campus France Studying in France is a French government website that provides resources and advice for students wishing to study in France which EA should be familiar with.
Germany
In Germany, Educational Advisors are required to hold a business license/registration and are governed by general civil law regulations. Educational Advisors should comply in all respects with all provisions of the Code of Conduct for German Universities Regarding International Students.
Where also a UK regulated Higher Education Institution, Educational Advisors must additionally be familiar with and comply with relevant aspects of the UK Regulatory system, including the “British Council’s Guide to Good Practice for Education Agents”.
Netherlands
All Educational Advisors providing services to Navitas or any Navitas Dutch business unit / college must read, understand and be familiar with and must comply in all respects with all the provisions of the Dutch Code of Conduct International Student Higher Education including without limitation, provisions relating to representation or advice on an immigration application, proceeding or matter by any party.
New Zealand
For New Zealand all Educational Advisors must be familiar with and abide by New Zealand’s The Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021, and the Student Fee Protection Rules 2022.
Singapore
Educational Advisors must be familiar with the Singapore Private Education Act 2009 and all other legislation and regulations as administered and governed by SkillsFuture Singapore (SSG) for Private Education Institutions (PEIs) in Singapore. Additionally Educational Advisors must comply with applicable obligations as legislated in the Consumer Protection Act.
United Arab Emirates
In the United Arab Emirates (UAE), Educational Advisors must hold a business license and are required to seek approval for holding events within the UAE.
United Kingdom
In the United Kingdom, all Educational Advisors must be familiar with and comply in all aspects with the UK’s Points Based Immigration System (including amendments that are made from time to time), as well as any applicable laws and regulations surrounding Consumer Protection (Distance Selling), and Data Protection. Additionally, all Educational Advisors are expected to act in full accordance with the UK Agent Quality Framework, the National Code of Ethical Practice for Education Agents and the British Council’s Guide to Good Practice for Education Agents.
Educational Advisors must be familiar with the guidelines set out under the Quality Assurance Agency for Higher Education (QAA), UK Visa and Immigration (UKVI) and the Office for Students (OFS), England’s Higher Education Regulator.
United States of America
In the United States of America (USA), Educational Advisors must abide by the American International Recruitment Council (AIRC) AIRC Certification Standards 2013, and AIRC Best Practices in International Recruitment.
